1. ELIGIBILITY TO PURCHASE
The purchase of our products through the Website is strictly limited to parties who can lawfully enter into and form contracts on the Internet in accordance with the laws of the United Arab Emirates. In order to make purchases on the Website, you will be required to provide your personal details. In particular, you must provide your real name, phone number, email address, and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct, and you confirm that you are the person referred to in the billing information provided.

2. ORDERS
2.1. You will be provided with the steps to navigate the order and payment process and will be required to provide us with your details, delivery address, together with contact details for the recipient.

2.2. By clicking the ‘Pay now’ button at the end of the order process, you agree to our terms and conditions. Once the order is received and accepted from our side, we will send an email confirmation to the email address you have provided.

3. PRICING POLICY
3.1. Prices shown for our products on the Website are in AED and are exclusive of taxes. These prices are subject to change at any time in our sole discretion.

3.2. The payment options available are:

Payment via a direct link (cards of any country except for sanctioned banks)
Payment to a RUB bank account (for Russian cards)
Cash payments upon delivery
USDT (TRC20, ERC20)

The payment method will be specified upon order confirmation with our manager.

3.3. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

4. ACCEPTANCE OF YOUR ORDER
4.1. Once you have placed your order, you will receive an email acknowledging the details of your order. This email is not an acceptance of your order, just a confirmation that we have received your order. Acceptance of the order and completion of the contract between you and Garden Flowers will be perfected when we dispatch the products to you, at which time you will receive an email or message containing your tracking number, and confirming that your order has been dispatched. The sale contract is therefore concluded in the United Arab Emirates.

4.2. We reserve the right not to accept or fulfill your order in the event that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular product, that the product ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within these Terms. Furthermore, we may refuse to process your order for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party in this respect.

4.3. Though we make every effort to make sure details on our Website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfill an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the products, we shall refund the full amount as soon as we are able. In the event that products are recalled in transit, we will process your refund once the products have been returned to us.

4.4. Garden Flowers provides the right to change the bouquet due to the perishable nature of our products, but not more than 20% of the original order.

5. PAYMENT
Payment can be made by Visa, MasterCard, MIR, and any other methods which may be clearly advertised on the Website from time to time. Once the transaction is complete, the payment will be debited and cleared from your account, and you will then be redirected to the Website. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your credit/debit card refuses to authorize payment, we will not be liable for any delay or non-delivery. We take reasonable care to make our Website secure.

6. DELIVERY
6.1. We offer free shipping within Dubai from 2,000 AED.

6.2. Please contact us immediately via email or WhatsApp if you have any problems with your order. On average, flowers should last anywhere from 3-7 days.

6.3. Remember, flowers are a perishable product; different flower varieties have different life spans and can be more delicate compared to other flower species. Aftercare is important to increase the longevity of your flowers. Should your flowers perish within 48 hours of their delivery date and we are satisfied that all care instructions provided have been followed, Garden Flowers will be happy to resend a new bunch of flowers or issue a refund.

6.4. In order to avoid flower delivery delays, please ensure that the full address details are provided as well as the telephone number for the intended recipient. Please also provide your telephone number and email address so that we can notify you of any issues we may encounter.

6.5. If you would like us to deliver to locations where a third party is involved, such as offices, hospitals, airports, and hotels, the signature of a person authorized to accept delivery on behalf of the individual or organization will be accepted as proof of delivery to your chosen recipient. In cases where we are unable to find someone to accept delivery, or make contact and rearrange delivery, or if the recipient fails to make contact in good time, we reserve the right to charge for re-delivery to that or an alternative address.

6.6. We will deliver the goods to the address provided in good faith and we cannot accept responsibility if the intended recipient is no longer at that address and the receiver refuses or fails to return the items.

7. RETURNS AND REFUNDS
7.1. To change or cancel your order, please contact us via email at gardenflowers@bk.ru or WhatsApp +971561441139 at least 48 hours before the scheduled delivery date. Due to the perishable nature of flowers, we cannot accept returns once dispatched. Customized goods may also be non-returnable once the customization process has begun.

7.2. We guarantee flowers for 72 hours from the time of delivery.

7.3. If the recipient receives damaged or sub-standard flowers, please contact us immediately so we can arrange the following:

A resend on the next or the same available delivery date; or
A full refund

8. CANCELLATION
8.1. Order Cancellation Before Dispatch: Garden Flowers makes every effort to ensure that you receive excellent service. If, at any time, you experience problems with an order, please let us know. You may cancel your order at any time before it has been dispatched. To do so, please contact us via email at the support team.

8.2. Cancellation After Dispatch: Once an order has been dispatched, cancellations are no longer possible due to the perishable nature of our products. Same-day orders are processed immediately, and usually cannot be cancelled.
Note: A refund will be processed by Garden Flowers in the event Garden Flowers determines that the cancellation of the order is due to Garden Flowers’s incapability of fulfilling the order.

Any controversy, claim, or dispute arising out of or relating to these Terms and Conditions will be referred to and finally settled by private and confidential binding arbitration before a single arbitrator held in Dubai, UAE in English and governed by Dubai law pursuant to the Rules of Commercial Conciliation and Arbitration of 1994 (Dubai), as amended, replaced, or re-enacted from time to time. The arbitrator shall be a person who is legally trained and who has experience in the information technology field in Dubai and is independent of either party.
